Terms of Service
These Terms govern your use of the PepTrack iOS application ("Service") operated by Tuned Tech LLC. By downloading or using PepTrack, you agree to these Terms in full. If you do not agree, do not use the Service.
1. Not Medical Advice
PepTrack is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. It is a personal tracking and informational tool only. Nothing in this app constitutes medical advice, medical guidance, diagnosis, treatment, or a recommendation of any kind.
Any information displayed within the app, including but not limited to descriptions of peptides, general usage information, or reference data contributed by the community, is provided solely for informational and educational purposes. It has not been evaluated, approved, or endorsed by the U.S. Food and Drug Administration (FDA) or any other regulatory authority.
Peptides and related compounds may be controlled, regulated, or prohibited in your jurisdiction. It is your sole responsibility to understand and comply with all applicable laws and regulations in your location before using, purchasing, or handling any such compounds.
Always consult a licensed, qualified healthcare provider before starting, stopping, or changing any health, medical, or supplementation protocol. Tuned Tech LLC assumes no responsibility for any decisions made based on information accessed through this app.
Use of PepTrack does not create a doctor-patient relationship or any other professional relationship between you and Tuned Tech LLC.
2. Eligibility
You must be at least 16 years old to use PepTrack. By using the Service, you confirm that you are 16 or older and that you have the legal capacity to enter into these Terms.
3. Service Description
PepTrack provides tools for personal peptide logging, protocol scheduling, dose reminders, and access to general informational content about peptides. The app is intended strictly for personal organizational and reference use. It is not a medical application and does not provide professional health services of any kind.
4. Accounts and Data
- Creating an account is optional. You may use PepTrack without providing any personal information.
- If you choose to set a username, that username and your onboarding completion status are stored on our servers via Supabase. No other personal information is required or collected through your account.
- All other app data, including your dose logs, protocols, schedules, and personal notes, is stored locally on your device and is not transmitted to our servers.
- You can delete your local data at any time by deleting the app. To request deletion of any server-stored data, contact us at support.peptrack@gmail.com.
5. Subscriptions and Billing
PepTrack requires a subscription to access full features. Subscriptions are processed by Apple via In-App Purchase and are managed through your App Store account. Pricing, free trials, renewals, cancellations, and refunds are governed by Apple's terms and applicable law. You may cancel at any time via iOS Settings > Apple ID > Subscriptions.
6. Acceptable Use
- Do not use PepTrack for any unlawful purpose or in violation of any applicable laws or regulations.
- Do not attempt to reverse engineer, decompile, or tamper with the Service.
- Do not misuse the Service in any way that could interfere with its operation or the experience of other users.
- Do not use the Service to distribute, promote, or facilitate the illegal acquisition or use of any controlled substances or regulated compounds.
7. Intellectual Property
All rights, title, and interest in and to PepTrack, including its software, design, branding, content, and related materials, are exclusively owned by Tuned Tech LLC. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works without prior written consent.
8. Third-Party Services
PepTrack uses the following third-party services to operate and improve the app:
- Apple In-App Purchase - subscription and payment processing.
- Supabase - stores optional username and onboarding completion data on secure servers.
- PostHog - anonymous in-app analytics used to understand how users navigate the app and to improve the user experience. PostHog does not collect personally identifiable information.
- Superwall - subscription paywall management and presentation.
Each of these services is subject to its own terms and privacy policy. Tuned Tech LLC is not responsible for the practices of these third-party providers.
9. Disclaimers
The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or fitness for a particular purpose of any content within the app.
We are not responsible for any harm, injury, adverse reaction, legal consequence, or other outcome resulting from actions taken based on information accessed through PepTrack. The informational content in the app is not a substitute for professional medical, legal, or regulatory advice.
10. Limitation of Liability
To the maximum extent permitted by law, Tuned Tech LLC and its members, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
In no event shall our total aggregate liability exceed the amount you paid for the Service in the six months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Tuned Tech LLC and its members, affiliates, and agents from any claims, liabilities, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or third-party right.
12. Service Modifications
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, for maintenance, updates, legal compliance, or business reasons.
13. Changes to These Terms
We may update these Terms periodically. If changes are material, we may notify users in-app. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
14. Termination
You may stop using the Service at any time by deleting the app. We may suspend or terminate your access if you violate these Terms or if your use poses a risk to the Service or other users.
15. Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration under the rules of the American Arbitration Association, rather than in court. You and Tuned Tech LLC each waive the right to a jury trial and the right to participate in a class action lawsuit or class-wide arbitration.
This agreement to arbitrate does not apply to claims that qualify for small claims court, or to claims of intellectual property infringement.
16. Governing Law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles.
